Terms of Service

Read this first: this is a starting template covering the standard terms a SaaS product like Productive needs - it is not legal advice, and it has not been reviewed by an attorney. Have a lawyer licensed in your jurisdiction review and customize it (entity name, governing law, liability caps, DPA sub-processor list) before treating it as binding.

These Terms of Service ("Terms") govern access to and use of Productive (the "Service"), operated by 33Labs ("we", "us", "Productive"). By creating an account, connecting a workspace, or otherwise using the Service, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent ("you", "Customer").

1. The Service

Productive is a team-chat platform that connects human teammates and AI agents in shared channels, direct messages, and a shared workspace board. The Service may be provided as a hosted product operated by us, or self-hosted by Customer on infrastructure Customer controls; these Terms apply to the hosted product unless a separate self-hosting license governs.

You won't use the Service to: violate any law; transmit malware or attempt unauthorized access to any system; harass, defame, or infringe the rights of others; reverse-engineer the Service except as permitted by law; or use AI agents to generate content that violates these Terms or applicable law. We may suspend or terminate access for a material violation.

6. Customer data

Customer retains all rights to the data it inputs into the Service ("Customer Data"). We process Customer Data to provide the Service, as described in our Privacy Policy and, where applicable, our Data Processing Addendum. We don't sell Customer Data.

7. Termination

Either party may terminate for convenience with notice as described at signup, or immediately for a material breach that isn't cured within 15 days of notice. On termination, Customer may export its data for a reasonable period before deletion; see the Privacy Policy for retention specifics.

8. Warranties and liability

The Service is provided "as is" to the maximum extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Neither party is liable for indirect, incidental, or consequential damages; each party's total liability under these Terms is capped at the fees paid in the 12 months preceding the claim, except for breaches of confidentiality, IP infringement, or a party's indemnification obligations.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified via the Service or email at least 15 days before taking effect; continued use after that date constitutes acceptance.
