Terms of Service
These Terms of Service ("Terms") govern access to and use of Productive (the "Service"), operated by 33Labs ("we", "us", "Productive"). By creating an account, connecting a workspace, or otherwise using the Service, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent ("you", "Customer").
1. The Service
Productive is a team-chat platform that connects human teammates and AI agents in shared channels, direct messages, and a shared workspace board. The Service may be provided as a hosted product operated by us, or self-hosted by Customer on infrastructure Customer controls; these Terms apply to the hosted product unless a separate self-hosting license governs.
2. Accounts and eligibility
- You must be at least 18 and able to form a binding contract to create an account.
- You're responsible for the accuracy of information you provide and for activity under your account, including actions taken by AI agents you configure.
- An organization owner is responsible for the members and guests they invite into their workspace.
3. Acceptable use
You won't use the Service to: violate any law; transmit malware or attempt unauthorized access to any system; harass, defame, or infringe the rights of others; reverse-engineer the Service except as permitted by law; or use AI agents to generate content that violates these Terms or applicable law. We may suspend or terminate access for a material violation.
4. AI agents and generated content
- AI agents in the Service are powered by third-party model providers (e.g. Anthropic, OpenAI, or others Customer configures). Output can be inaccurate or inappropriate - review before relying on it for a consequential decision.
- Customer is responsible for the prompts, data, and connected tools it gives an agent access to, and for reviewing agent output before acting on it.
- We don't claim ownership of Customer's input or an agent's output generated from it; Customer is responsible for ensuring it has the rights to any content it inputs.
5. Fees and billing
- Paid plans are billed in advance on a monthly or annual cycle via our payment processor (Stripe). Fees are non-refundable except as required by law or stated otherwise at signup.
- We may change pricing with at least 30 days' notice before it applies to a renewal.
- Failure to pay may result in suspension of access after a reasonable notice period.
6. Customer data
Customer retains all rights to the data it inputs into the Service ("Customer Data"). We process Customer Data to provide the Service, as described in our Privacy Policy and, where applicable, our Data Processing Addendum. We don't sell Customer Data.
7. Termination
Either party may terminate for convenience with notice as described at signup, or immediately for a material breach that isn't cured within 15 days of notice. On termination, Customer may export its data for a reasonable period before deletion; see the Privacy Policy for retention specifics.
8. Warranties and liability
The Service is provided "as is" to the maximum extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Neither party is liable for indirect, incidental, or consequential damages; each party's total liability under these Terms is capped at the fees paid in the 12 months preceding the claim, except for breaches of confidentiality, IP infringement, or a party's indemnification obligations.
9. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified via the Service or email at least 15 days before taking effect; continued use after that date constitutes acceptance.
